most companies will not do background checks unless they are interested in hiring you, which would mean they would interview you, then have you fill out an application which you sign and agree to let them do.
if you refuse to sign for the background check, then you will never be considered for the job.
for companies to do this on everyone they consider, the cost would be prohibted.
here is another consideration that most people dont think about. are you on facebook or myspace?? more employers are checking these out first. most people dont realize that what they put out there about themselves can prevent them from getting a job, since they think only their friends are checking them out.
if you are on either of those sites, better think what you put out there or it might bite you in the a** later.

You have to give permission for background checks to be done, they usually will only do them if you are one of the top applicants after they have done all the initial interviews. They usually only do background checks on finalists because they don;t want to waste money and time doing them on people that won’t pass the interview process.
Some applications say that by signing them you are allowing a background check, drug screening, etc. However those have rarely held up in court. Companies that do these checks more then likely will have you sign a separate authorization, for each type of check.
Unless you authorize previous employers to release information on your preformance, previous employers are only allowed to state when you started, when you stopped working there and postions held.
Depends on what you mean by a background check.
Anything that is public record (and yes, this includes your facebook and myspace so be smart!) they can look at whenever.
They can call your references as soon as you give them names and numbers as well as past employers so long as you check the box saying “yes, it’s okay for you to contact my employer.”
If you mean “real” background checks where they may call your family, friends, coworkers, and do some deep digging (like the would if you were applying for a job like being a police officer) then you need to sign a form which they will give to you. These aren’t very common.
Some employers like to do credit checks to see if you are likely to accept a bribe or to embezzle and you will need to sign a paper for them to do that as well.
They have to have a signed release from you, or at least an online agreement that you agreed to. Without that, they are breaking the law. But if you refuse to allow them that right, they will never even interview you probably.
They can do it whenever they want during the hiring process. They usually get an authorization from you before doing it, but not always. The application probably had a built in authorization.
They have to get your signed permission to do a credit check, but they can check public records like court records and such without permission whenever they like.
